Electronic Signature Consent Disclosure

This portal delivers agreements and disclosures electronically. This page explains what that means, what you need to access them, and how to change your mind.
Consent to do business electronically
By checking the consent box in the portal, you agree that Cap Fi Capital may provide records, disclosures, and agreements to you electronically, and that your electronic signature has the same legal effect as a handwritten signature under the federal E-SIGN Act and applicable state UETA law.
Records covered by your consent
Your consent applies to records including, but not limited to:
- The Client Authorization and Broker Disclosure.
- Funding contracts, engagement agreements, and amendments.
- Lender submission authorizations and related notices.
- Invoices, receipts, and payment records.
- This E-Sign Consent Disclosure, the Terms of Service, and the Privacy Policy.
- Status notices, reminders, and other communications about your file.
How we deliver electronic records
We deliver records by making them available inside the portal and, where appropriate, by sending them to the email address on your account. It is your responsibility to keep your email address current in the portal so you continue to receive notices.
Hardware and software you need
To access and keep electronic records you need:
- A device with internet access and a current version of a major browser (Chrome, Safari, Edge, or Firefox).
- An active email account and the ability to receive email from our domain.
- The ability to view and save PDF and image files.
- Sufficient storage or a printer if you wish to keep your own copies.
How your signature is captured
When you sign, we record your typed legal name, the signature you draw on screen, the date and time of signing, and the device and network information available at the time. These records are stored with the signed document as evidence of your signature.
Requesting paper copies
You may request a paper copy of any record signed or delivered electronically by emailing Christopher@capficapital.com. We do not charge a fee for paper copies unless we tell you otherwise in advance.
Withdrawing your consent
You may withdraw your consent to receive records electronically at any time by emailing Christopher@capficapital.com with your name and account email. Withdrawal takes effect once we have had a reasonable time to process it, and it does not affect the validity of records you already signed electronically. Because the portal operates electronically, withdrawing consent may mean we can no longer serve you through the portal.
Keeping your contact information current
Update your email address and phone number in your portal settings, or email Christopher@capficapital.com, so we can continue to deliver records to you.
