Terms of Service

These terms cover how you may use the portal, what Cap Fi does as a finance broker, and what we each agree to.
Agreement to these terms
These Terms of Service govern your use of the Cap Fi Capital portal at portal.capficapital.com. By creating an account or using the portal, you agree to these terms. If you do not agree, do not use the portal.
Who may use the portal
You must be at least 18 years old and authorized to act on behalf of the business you register. Accounts are for business financing purposes, not personal consumer lending.
What Cap Fi does — and does not do
Cap Fi Capital is a commercial, equipment, and working capital finance broker. We present your business to lenders and funding partners in order to help you seek capital. We are not a lender, and we do not make credit decisions.
Cap Fi is not a financial advisor, accountant, attorney, tax professional, or investment advisor, and nothing in the portal is financial, legal, accounting, tax, or investment advice. You should consult your own licensed professionals before making financial decisions.
We do not guarantee approval, funding, amounts, rates, or terms. All credit decisions are made solely by the lender or funding partner.
Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately if you believe your account has been accessed without your permission. Do not share your account with anyone else.
Accuracy of the information you provide
You agree that all information and documentation you submit is true, accurate, current, and complete, and that it belongs to you and/or the business listed on your application. Submitting false, altered, or fraudulent information is grounds for immediate termination and may be reported to lenders and authorities.
Authorization to submit your file
By submitting your information, you authorize Cap Fi to present that information and those documents to prospective lenders and funding partners for the purpose of obtaining business financing on your behalf.
Affiliate program
Affiliates may refer prospective clients and track their progress in a limited view. Commission rates are set by Cap Fi at its sole discretion and may differ by affiliate and by deal. Commissions are earned only on transactions that actually fund and are paid after Cap Fi has received its own compensation. Affiliates may not contact lenders directly, may not represent themselves as Cap Fi, and may not access or request a client's personal identification, tax, banking, or credit documents.
Fees and invoices
Any fees payable by you will be disclosed to you before they are charged and issued as an invoice inside the portal. Invoices are due by the date shown. Payments are processed by third-party payment processors subject to their own terms.
Acceptable use
You agree not to:
- Upload malicious code or attempt to access accounts, files, or data that are not yours.
- Interfere with, probe, or disrupt the portal or its security features.
- Use the portal to submit another person's information without their authorization.
- Copy, scrape, or resell portal content, lender lists, or other users' information.
Electronic records and signatures
Agreements and disclosures in the portal are provided and signed electronically. See our E-Sign Consent Disclosure for details about your consent, the requirements to access electronic records, and how to withdraw consent or request paper copies.
Intellectual property
The portal, its design, and its content are owned by Cap Fi and its licensors. You keep ownership of the information and documents you upload, and you grant us permission to use them to provide the service described here.
Termination
You may stop using the portal and request account closure at any time. We may suspend or terminate access if you violate these terms, if we suspect fraud, or if we discontinue the service. Sections that by their nature should survive termination will survive.
Disclaimers and limitation of liability
The portal is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. To the fullest extent permitted by law, Cap Fi is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business opportunities, and our total liability arising out of or relating to the portal will not exceed the amount of fees you paid to Cap Fi in the twelve months before the claim.
Changes to these terms
We may update these terms. When we do, we will change the “Last updated” date and, when the change is significant, notify you in the portal or by email. Continued use after an update means you accept the updated terms.
Governing law
These terms are governed by the laws of Virginia, without regard to its conflict-of-law rules. Any dispute will be brought in the courts located in Virginia.
